云南省人民政府辦公廳關于加快推進政府性融資擔保高質量發展的實施意見
各州(市)人(ren)民政府,省直各委、辦(ban)、廳、局,中(zhong)央駐滇有(you)關單位(wei),有(you)關金融機構:
為進一步發揮政(zheng)府(fu)性融資擔(dan)(dan)保穩增長、調(diao)結構、促(cu)改革、惠民生(sheng)的重要(yao)作(zuo)用,發揮逆周期調(diao)節(jie)功能,助力(li)小(xiao)微企業和“三農”主體紓困發展(zhan)(zhan),更(geng)好(hao)服務“3815”戰略發展(zhan)(zhan)目標,現(xian)就加快推進我省政(zheng)府(fu)性融資擔(dan)(dan)保高(gao)質量(liang)發展(zhan)(zhan)提出以下意見(jian)。
一、明確發展定位目標
(一)明確發展定(ding)位(wei)。以習近平(ping)新時(shi)代中(zhong)(zhong)國(guo)特色社會主義(yi)思想為指導,全面(mian)貫徹落實(shi)黨的二十(shi)大(da)和二十(shi)屆(jie)二中(zhong)(zhong)、三中(zhong)(zhong)全會精(jing)神,認真落實(shi)省委十(shi)一屆(jie)七次全會要(yao)求(qiu),堅持(chi)(chi)穩中(zhong)(zhong)求(qiu)進工作總基調,聚(ju)焦解決擔保(bao)合力不(bu)強、銀擔合作不(bu)暢(chang)、擔保(bao)支(zhi)持(chi)(chi)行業過度集(ji)中(zhong)(zhong)、風(feng)險(xian)分擔機(ji)(ji)制(zhi)不(bu)健全等問(wen)題(ti),加大(da)政策扶持(chi)(chi)力度,持(chi)(chi)續優化擔保(bao)支(zhi)持(chi)(chi)的產業領域(yu),推動政府性融(rong)資擔保(bao)機(ji)(ji)構堅守準公共定(ding)位(wei),堅持(chi)(chi)保(bao)本微(wei)利,聚(ju)焦支(zhi)小支(zhi)農,不(bu)斷(duan)提升服務實(shi)體經濟能力。
(二)明確(que)發展(zhan)目標。政(zheng)府(fu)性(xing)融資(zi)(zi)擔(dan)(dan)保機構(gou)要圍繞“三大(da)經濟”,聚焦高原(yuan)特色農業(ye)(ye)、科(ke)(ke)技創新、文化(hua)旅游、新材料、生(sheng)物醫(yi)藥、先進裝備制造、綠色能源(yuan)、外(wai)貿(mao)等重點(dian)產(chan)(chan)業(ye)(ye)鏈(lian)優(you)化(hua)資(zi)(zi)源(yuan)配置。依托資(zi)(zi)源(yuan)稟賦,根據產(chan)(chan)業(ye)(ye)規劃,發揮興產(chan)(chan)業(ye)(ye)、強龍頭、聚鏈(lian)條、補短板功能。突(tu)(tu)出就(jiu)業(ye)(ye)優(you)先導向(xiang),優(you)先向(xiang)勞動密集型、就(jiu)業(ye)(ye)友(you)好(hao)型企業(ye)(ye)提(ti)供擔(dan)(dan)保服務(wu),更好(hao)支(zhi)持帶動就(jiu)業(ye)(ye)。加大(da)對科(ke)(ke)技創新企業(ye)(ye)支(zhi)持力度,推動科(ke)(ke)技產(chan)(chan)業(ye)(ye)鏈(lian)突(tu)(tu)圍,積極培育發展(zhan)新質生(sheng)產(chan)(chan)力。到2030年(nian)底,力爭(zheng)全(quan)省政(zheng)府(fu)性(xing)融資(zi)(zi)擔(dan)(dan)保機構(gou)支(zhi)小(xiao)支(zhi)農擔(dan)(dan)保貸款余額超過700億元,其中,聚焦重點(dian)產(chan)(chan)業(ye)(ye)鏈(lian)的擔(dan)(dan)保貸款余額力爭(zheng)不低于50%。
二(er)、完善融資擔保體系
(三(san)(san))規范三(san)(san)級(ji)(ji)(ji)風險分擔(dan)(dan)組織體系。按照(zhao)“國家融(rong)(rong)資(zi)(zi)(zi)(zi)擔(dan)(dan)保(bao)基(ji)金—省級(ji)(ji)(ji)政(zheng)(zheng)府性融(rong)(rong)資(zi)(zi)(zi)(zi)再擔(dan)(dan)保(bao)機構(gou)—州(市)級(ji)(ji)(ji)政(zheng)(zheng)府性融(rong)(rong)資(zi)(zi)(zi)(zi)擔(dan)(dan)保(bao)機構(gou)”三(san)(san)層組織架構(gou),規范推進我省政(zheng)(zheng)府性融(rong)(rong)資(zi)(zi)(zi)(zi)擔(dan)(dan)保(bao)體系建(jian)設,有(you)(you)效分散擔(dan)(dan)保(bao)機構(gou)風險,形(xing)(xing)成擔(dan)(dan)保(bao)合力。各(ge)級(ji)(ji)(ji)財(cai)政(zheng)(zheng)部門按照(zhao)本級(ji)(ji)(ji)政(zheng)(zheng)府授權(quan)履(lv)行出(chu)資(zi)(zi)(zi)(zi)人職責,對(dui)政(zheng)(zheng)府性融(rong)(rong)資(zi)(zi)(zi)(zi)擔(dan)(dan)保(bao)機構(gou)實施國有(you)(you)金融(rong)(rong)資(zi)(zi)(zi)(zi)本穿透(tou)管理(li),形(xing)(xing)成數量適(shi)中(zhong)、結構(gou)合理(li)、錯位發展(zhan)、穩健(jian)運行的“1+16”擔(dan)(dan)保(bao)體系。
(四)強化省(sheng)(sheng)級政(zheng)(zheng)府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)機(ji)構(gou)(gou)(gou)(gou)的(de)再(zai)擔(dan)(dan)(dan)(dan)保(bao)機(ji)構(gou)(gou)(gou)(gou)功能(neng)定位。省(sheng)(sheng)級政(zheng)(zheng)府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)機(ji)構(gou)(gou)(gou)(gou)要充分發揮(hui)龍頭作用,切實提升自身經營管(guan)(guan)理(li)水平和(he)風險(xian)控(kong)(kong)制(zhi)能(neng)力(li)(li),以再(zai)擔(dan)(dan)(dan)(dan)保(bao)業(ye)務(wu)(wu)(wu)為主建立全(quan)省(sheng)(sheng)統(tong)一的(de)政(zheng)(zheng)府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)體(ti)系。發揮(hui)“機(ji)構(gou)(gou)(gou)(gou)體(ti)系核心(xin)、扶持政(zheng)(zheng)策平臺、銀擔(dan)(dan)(dan)(dan)合作窗口”作用,放大業(ye)務(wu)(wu)(wu)經驗、風險(xian)管(guan)(guan)理(li)、資(zi)(zi)本、人才等(deng)方面的(de)優勢(shi),加強與國家(jia)融(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)基金合作,指導州(zhou)(市)級政(zheng)(zheng)府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)機(ji)構(gou)(gou)(gou)(gou)規范業(ye)務(wu)(wu)(wu)模式,持續擴大業(ye)務(wu)(wu)(wu)規模。逐步收回對州(zhou)(市)、縣(市、區(qu))融(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)公司的(de)股權(quan)投(tou)資(zi)(zi),統(tong)一管(guan)(guan)理(li)要求和(he)服務(wu)(wu)(wu)標準,制(zhi)定業(ye)務(wu)(wu)(wu)操作、風險(xian)控(kong)(kong)制(zhi)、內控(kong)(kong)管(guan)(guan)理(li)等(deng)指引,幫助(zhu)州(zhou)(市)級政(zheng)(zheng)府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)機(ji)構(gou)(gou)(gou)(gou)提升管(guan)(guan)理(li)水平和(he)抗(kang)風險(xian)能(neng)力(li)(li),達到增信、分險(xian)、規范作用,引領行業(ye)發展。
(五)壯(zhuang)大州(市(shi)(shi)(shi)(shi))級政(zheng)府(fu)性(xing)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)構(gou)(gou)實(shi)力(li)(li)。各州(市(shi)(shi)(shi)(shi))要統籌地(di)方財力(li)(li)和融(rong)(rong)資(zi)(zi)擔(dan)保(bao)資(zi)(zi)源,原(yuan)則(ze)上(shang)培育一(yi)家(jia)資(zi)(zi)本實(shi)力(li)(li)不(bu)低于3億元的州(市(shi)(shi)(shi)(shi))級政(zheng)府(fu)性(xing)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)構(gou)(gou),作為(wei)服務小(xiao)微(wei)企業和“三農”主體(ti)的主力(li)(li)軍,支撐(cheng)行業發(fa)展。在確保(bao)機(ji)構(gou)(gou)平穩運行、業務正常開展的前提下,積極穩妥(tuo)推進機(ji)構(gou)(gou)改革。無(wu)政(zheng)府(fu)性(xing)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)構(gou)(gou)的州(市(shi)(shi)(shi)(shi))要加快(kuai)機(ji)構(gou)(gou)新設(she),有(you)(you)政(zheng)府(fu)性(xing)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)構(gou)(gou)的州(市(shi)(shi)(shi)(shi))要加快(kuai)增資(zi)(zi)、合(he)并、重組(zu),統籌推進縣(xian)(市(shi)(shi)(shi)(shi)、區(qu)(qu))級財政(zheng)出資(zi)(zi)入股州(市(shi)(shi)(shi)(shi))級政(zheng)府(fu)性(xing)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)構(gou)(gou),原(yuan)則(ze)上(shang)縣(xian)(市(shi)(shi)(shi)(shi)、區(qu)(qu))不(bu)再(zai)保(bao)留政(zheng)府(fu)性(xing)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)機(ji)構(gou)(gou)。鼓(gu)勵有(you)(you)條件的州(市(shi)(shi)(shi)(shi))在經濟相對發(fa)達、小(xiao)微(wei)企業和“三農”主體(ti)融(rong)(rong)資(zi)(zi)需(xu)求旺盛的縣(xian)(市(shi)(shi)(shi)(shi)、區(qu)(qu))設(she)立辦事處,不(bu)斷增強(qiang)融(rong)(rong)資(zi)(zi)擔(dan)保(bao)服務能力(li)(li)。
(六)加(jia)強政府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)保(bao)機(ji)(ji)(ji)構(gou)(gou)名單(dan)(dan)管理。省(sheng)財政廳要(yao)會(hui)同省(sheng)金融(rong)管理局等部(bu)門開展(zhan)政府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)保(bao)機(ji)(ji)(ji)構(gou)(gou)確(que)認工作(zuo),建立政府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)保(bao)機(ji)(ji)(ji)構(gou)(gou)名單(dan)(dan),并實(shi)行工作(zuo)考(kao)核(he)(he),督(du)促(cu)其實(shi)現法人(ren)、業(ye)務(wu)(wu)、財務(wu)(wu)、考(kao)核(he)(he)、管理“五獨立”,避免政策(ce)性(xing)業(ye)務(wu)(wu)邊緣(yuan)化(hua)和外部(bu)風險導入。分類監管評級B級以下、擔(dan)保(bao)能(neng)力不足(zu)、違法違規(gui)經(jing)營、出現重(zhong)(zhong)大風險的(de)(de)機(ji)(ji)(ji)構(gou)(gou)要(yao)退(tui)出政府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)保(bao)機(ji)(ji)(ji)構(gou)(gou)名單(dan)(dan),待(dai)整改完成(cheng)后重(zhong)(zhong)新納入名單(dan)(dan)管理。分類監管評級B級以下機(ji)(ji)(ji)構(gou)(gou),經(jing)濟(ji)效(xiao)益及社會(hui)效(xiao)益作(zuo)用(yong)發揮明顯(xian)、業(ye)務(wu)(wu)占(zhan)比符合要(yao)求的(de)(de),納入政府(fu)性(xing)融(rong)資(zi)(zi)擔(dan)保(bao)機(ji)(ji)(ji)構(gou)(gou)重(zhong)(zhong)點監管名單(dan)(dan),在限(xian)制經(jing)營范(fan)圍內開展(zhan)擔(dan)保(bao)業(ye)務(wu)(wu)。
三、聚焦支小支農主業
(七)回(hui)歸擔(dan)(dan)保(bao)主(zhu)業(ye)(ye)。各(ge)州(市(shi))政府(fu)性融資(zi)擔(dan)(dan)保(bao)機構要(yao)合(he)理界定服(fu)務(wu)對象范圍(wei),聚焦我省(sheng)(sheng)重點產業(ye)(ye)鏈中(zhong)的(de)(de)小(xiao)微企業(ye)(ye)、個(ge)體工商戶、農戶、新型農業(ye)(ye)經營(ying)主(zhu)體等,確保(bao)支(zhi)(zhi)(zhi)小(xiao)支(zhi)(zhi)(zhi)農擔(dan)(dan)保(bao)業(ye)(ye)務(wu)規(gui)模和戶數占比達到(dao)80%以(yi)上。單戶支(zhi)(zhi)(zhi)小(xiao)支(zhi)(zhi)(zhi)農擔(dan)(dan)保(bao)貸款金(jin)額不(bu)超過2000萬元,其中(zhong),500萬元(含(han))以(yi)下(xia)的(de)(de)擔(dan)(dan)保(bao)金(jin)額占比不(bu)低于50%。到(dao)2028年,省(sheng)(sheng)級政府(fu)性融資(zi)擔(dan)(dan)保(bao)機構支(zhi)(zhi)(zhi)小(xiao)支(zhi)(zhi)(zhi)農再擔(dan)(dan)保(bao)責(ze)任(ren)金(jin)額占全部擔(dan)(dan)保(bao)責(ze)任(ren)金(jin)額的(de)(de)比例不(bu)低于80%。逐步降(jiang)低或(huo)免除支(zhi)(zhi)(zhi)小(xiao)支(zhi)(zhi)(zhi)農貸款反擔(dan)(dan)保(bao)要(yao)求,原(yuan)則上100萬元(含(han))以(yi)下(xia)的(de)(de)支(zhi)(zhi)(zhi)小(xiao)支(zhi)(zhi)(zhi)農擔(dan)(dan)保(bao)貸款不(bu)設(she)置資(zi)產抵質押反擔(dan)(dan)保(bao)措施(shi)。
(八)突出重(zhong)點對(dui)象(xiang)。政府性(xing)融(rong)資(zi)擔保(bao)機構要重(zhong)點支持單戶擔保(bao)金(jin)(jin)額(e)500萬元(yuan)(含)以下的小微(wei)(wei)企(qi)(qi)業(ye)(ye)(ye)(ye)和(he)“三農”主體,優(you)(you)先(xian)為貸(dai)款信用(yong)記錄和(he)有效抵質(zhi)押品(pin)不(bu)足但產(chan)品(pin)有市場、項目有前景、技術(shu)有競爭力的小微(wei)(wei)企(qi)(qi)業(ye)(ye)(ye)(ye)和(he)“三農”主體融(rong)資(zi)提(ti)供擔保(bao)增信。在風險可控前提(ti)下,結合地方優(you)(you)勢(shi)特色產(chan)業(ye)(ye)(ye)(ye)創新擔保(bao)產(chan)品(pin)。持續優(you)(you)化支持重(zhong)點產(chan)業(ye)(ye)(ye)(ye)結構,積(ji)極為重(zhong)點產(chan)業(ye)(ye)(ye)(ye)鏈(lian)供應鏈(lian)中的企(qi)(qi)業(ye)(ye)(ye)(ye)及上下游企(qi)(qi)業(ye)(ye)(ye)(ye)提(ti)供擔保(bao)服(fu)務(wu),通過供應鏈(lian)金(jin)(jin)融(rong)實現業(ye)(ye)(ye)(ye)務(wu)聚散為整、集約作業(ye)(ye)(ye)(ye)。
(九)引導降費(fei)讓利。政府性(xing)(xing)融(rong)(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)(bao)機(ji)構(gou)在可持續(xu)經營(ying)的(de)(de)前提下(xia)要(yao)調降擔(dan)(dan)(dan)(dan)保(bao)(bao)費(fei)率(lv)。其中,單戶擔(dan)(dan)(dan)(dan)保(bao)(bao)金額(e)(e)500萬元(含)以下(xia)的(de)(de)業務(wu),各州(zhou)(市(shi))政府性(xing)(xing)融(rong)(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)(bao)機(ji)構(gou)向(xiang)小微企業和(he)“三(san)農(nong)”主體(ti)收取(qu)(qu)的(de)(de)擔(dan)(dan)(dan)(dan)保(bao)(bao)費(fei)率(lv)原(yuan)(yuan)則上(shang)(shang)不超(chao)過(guo)擔(dan)(dan)(dan)(dan)保(bao)(bao)貸(dai)款(kuan)(kuan)金額(e)(e)的(de)(de)1%,省級政府性(xing)(xing)融(rong)(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)(bao)機(ji)構(gou)向(xiang)州(zhou)(市(shi))級機(ji)構(gou)收取(qu)(qu)的(de)(de)再擔(dan)(dan)(dan)(dan)保(bao)(bao)費(fei)率(lv)原(yuan)(yuan)則上(shang)(shang)不超(chao)過(guo)擔(dan)(dan)(dan)(dan)保(bao)(bao)貸(dai)款(kuan)(kuan)金額(e)(e)的(de)(de)0.12%。單戶擔(dan)(dan)(dan)(dan)保(bao)(bao)金額(e)(e)500萬元以上(shang)(shang)、2000萬元(含)以下(xia)的(de)(de)業務(wu),各州(zhou)(市(shi))政府性(xing)(xing)融(rong)(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)(bao)機(ji)構(gou)向(xiang)小微企業和(he)“三(san)農(nong)”主體(ti)收取(qu)(qu)的(de)(de)擔(dan)(dan)(dan)(dan)保(bao)(bao)費(fei)率(lv)原(yuan)(yuan)則上(shang)(shang)不超(chao)過(guo)擔(dan)(dan)(dan)(dan)保(bao)(bao)貸(dai)款(kuan)(kuan)金額(e)(e)的(de)(de)1.5%,省級政府性(xing)(xing)融(rong)(rong)資(zi)(zi)擔(dan)(dan)(dan)(dan)保(bao)(bao)機(ji)構(gou)向(xiang)州(zhou)(市(shi))級機(ji)構(gou)收取(qu)(qu)的(de)(de)再擔(dan)(dan)(dan)(dan)保(bao)(bao)費(fei)率(lv)原(yuan)(yuan)則上(shang)(shang)不超(chao)過(guo)擔(dan)(dan)(dan)(dan)保(bao)(bao)貸(dai)款(kuan)(kuan)金額(e)(e)的(de)(de)0.15%。
四、健全(quan)銀擔合作機制
(十)創新(xin)銀擔(dan)合作(zuo)(zuo)模式。省(sheng)級(ji)(ji)政(zheng)府性(xing)融(rong)(rong)資擔(dan)保機(ji)構(gou)(gou)(gou)(gou)要推動與(yu)銀行業金(jin)融(rong)(rong)機(ji)構(gou)(gou)(gou)(gou)省(sheng)級(ji)(ji)分支機(ji)構(gou)(gou)(gou)(gou)的“總對總”合作(zuo)(zuo),引(yin)導銀行業金(jin)融(rong)(rong)機(ji)構(gou)(gou)(gou)(gou)擴大(da)分支機(ji)構(gou)(gou)(gou)(gou)審(shen)批權限,在授信額度、擔(dan)保放大(da)倍數、貸(dai)款利率、續貸(dai)條(tiao)件(jian)、免收保證金(jin)、風險緩釋化解等方面為(wei)州(市)級(ji)(ji)政(zheng)府性(xing)融(rong)(rong)資擔(dan)保機(ji)構(gou)(gou)(gou)(gou)提(ti)(ti)供更多優(you)惠。支持(chi)政(zheng)府性(xing)融(rong)(rong)資擔(dan)保機(ji)構(gou)(gou)(gou)(gou)與(yu)地方法(fa)人銀行業金(jin)融(rong)(rong)機(ji)構(gou)(gou)(gou)(gou)開展合作(zuo)(zuo),助力地方優(you)勢(shi)特色(se)產業提(ti)(ti)檔升(sheng)級(ji)(ji)。
(十一)明確風(feng)險(xian)分(fen)(fen)擔(dan)(dan)(dan)比(bi)例。健全省(sheng)級政府性融(rong)資(zi)擔(dan)(dan)(dan)保(bao)(bao)機構(gou)(風(feng)險(xian)分(fen)(fen)擔(dan)(dan)(dan)40%)、州(zhou)(市)級政府性融(rong)資(zi)擔(dan)(dan)(dan)保(bao)(bao)機構(gou)(風(feng)險(xian)分(fen)(fen)擔(dan)(dan)(dan)40%)和(he)銀行業(ye)(ye)金融(rong)機構(gou)(風(feng)險(xian)分(fen)(fen)擔(dan)(dan)(dan)20%)的(de)“442”銀擔(dan)(dan)(dan)風(feng)險(xian)分(fen)(fen)擔(dan)(dan)(dan)機制。符合國家融(rong)資(zi)擔(dan)(dan)(dan)保(bao)(bao)基金要求的(de)業(ye)(ye)務(wu),省(sheng)級政府性融(rong)資(zi)擔(dan)(dan)(dan)保(bao)(bao)機構(gou)要積極爭取國家融(rong)資(zi)擔(dan)(dan)(dan)保(bao)(bao)基金再擔(dan)(dan)(dan)保(bao)(bao)風(feng)險(xian)分(fen)(fen)擔(dan)(dan)(dan),有效分(fen)(fen)散體系風(feng)險(xian)。對于貸(dai)款(kuan)規(gui)模(mo)增長快(kuai)、小微企業(ye)(ye)和(he)“三農”主(zhu)體戶數占比(bi)大的(de)銀行業(ye)(ye)金融(rong)機構(gou),政府性融(rong)資(zi)擔(dan)(dan)(dan)保(bao)(bao)機構(gou)可適當提高自(zi)身承擔(dan)(dan)(dan)的(de)風(feng)險(xian)責任比(bi)例或擴(kuo)大合作(zuo)貸(dai)款(kuan)規(gui)模(mo)。
(十二)推(tui)進數(shu)(shu)字融(rong)擔(dan)(dan)轉(zhuan)型。推(tui)動國家融(rong)資擔(dan)(dan)保(bao)(bao)基(ji)金SaaS系統州(市)業(ye)(ye)務全(quan)覆(fu)蓋,完善云南(nan)省融(rong)資信用服務平臺功能,打造我省政府性(xing)融(rong)資擔(dan)(dan)保(bao)(bao)體(ti)系信息服務中樞,推(tui)動“政、銀(yin)、企(qi)”信息互通和共享應(ying)用,結合(he)(he)大(da)數(shu)(shu)據、智能風控等金融(rong)科技手段,創(chuang)新開發(fa)“信用+擔(dan)(dan)保(bao)(bao)”新型金融(rong)服務產(chan)品。銀(yin)行業(ye)(ye)金融(rong)機(ji)構要做(zuo)深做(zuo)實(shi)普惠金融(rong)考核(he)激勵、資源傾斜、盡職免責(ze)等內部管(guan)理機(ji)制,針對小微企(qi)業(ye)(ye)輕資產(chan)特點,加(jia)大(da)“首貸戶”支持(chi)力(li)(li)度(du),與政府性(xing)融(rong)資擔(dan)(dan)保(bao)(bao)機(ji)構合(he)(he)力(li)(li)開發(fa)適合(he)(he)知識產(chan)權質押、應(ying)收賬款、存單(dan)(dan)、倉(cang)單(dan)(dan)、訂(ding)單(dan)(dan)和保(bao)(bao)單(dan)(dan)融(rong)資的(de)擔(dan)(dan)保(bao)(bao)產(chan)品,提升小微企(qi)業(ye)(ye)和“三農”主體(ti)融(rong)資便利(li)度(du)和可獲得(de)性(xing)。
五、強化財稅正向激(ji)勵
(十三)完善資(zi)(zi)本(ben)金補充機制(zhi)(zhi)。各(ge)州(市)要綜合(he)考慮支(zhi)小支(zhi)農(nong)擔(dan)保責任(ren)余(yu)額、責任(ren)余(yu)額放(fang)大倍數、風險防控等(deng)因素,建(jian)立可持續資(zi)(zi)本(ben)金補充機制(zhi)(zhi)。鼓(gu)勵參與銀(yin)擔(dan)合(he)作(zuo)的銀(yin)行業(ye)金融機構(gou)向(xiang)政府(fu)性融資(zi)(zi)擔(dan)保機構(gou)注資(zi)(zi)、捐資(zi)(zi)。省級(ji)(ji)財政要統籌中央和省級(ji)(ji)有關資(zi)(zi)金,支(zhi)持擔(dan)保放(fang)大倍數高、代償率控制(zhi)(zhi)在合(he)理區間、功能作(zuo)用(yong)發(fa)揮充分的州(市)級(ji)(ji)政府(fu)性融資(zi)(zi)擔(dan)保機構(gou)壯大資(zi)(zi)本(ben)實力,優先做強做大。
(十四)加大財政補(bu)(bu)(bu)助力(li)度。各州(市)要建立可持(chi)續擔(dan)保(bao)(bao)(bao)(bao)費補(bu)(bu)(bu)貼機制,確保(bao)(bao)(bao)(bao)政府(fu)性(xing)(xing)融資(zi)(zi)擔(dan)保(bao)(bao)(bao)(bao)機構(gou)(gou)(gou)保(bao)(bao)(bao)(bao)本微利運行。省級(ji)財政對省級(ji)政府(fu)性(xing)(xing)融資(zi)(zi)擔(dan)保(bao)(bao)(bao)(bao)機構(gou)(gou)(gou)開展的單戶(hu)擔(dan)保(bao)(bao)(bao)(bao)金(jin)額(e)(e)500萬元(yuan)(含(han))以下納入(ru)國家(jia)融資(zi)(zi)擔(dan)保(bao)(bao)(bao)(bao)基金(jin)備案(an)和認證(zheng)的支(zhi)小(xiao)支(zhi)農(nong)直保(bao)(bao)(bao)(bao)業(ye)(ye)務、1000萬元(yuan)(含(han))以下的支(zhi)小(xiao)支(zhi)農(nong)比例再擔(dan)保(bao)(bao)(bao)(bao)業(ye)(ye)務,按擔(dan)保(bao)(bao)(bao)(bao)貸款(kuan)金(jin)額(e)(e)的一定(ding)比例給予擔(dan)保(bao)(bao)(bao)(bao)費補(bu)(bu)(bu)貼。同時,根據支(zhi)持(chi)小(xiao)微企業(ye)(ye)和“三(san)農(nong)”主體在保(bao)(bao)(bao)(bao)責任余(yu)額(e)(e)、新(xin)增(zeng)(zeng)(zeng)擔(dan)保(bao)(bao)(bao)(bao)戶(hu)數、新(xin)增(zeng)(zeng)(zeng)擔(dan)保(bao)(bao)(bao)(bao)責任金(jin)額(e)(e)、新(xin)增(zeng)(zeng)(zeng)擔(dan)保(bao)(bao)(bao)(bao)責任金(jin)額(e)(e)增(zeng)(zeng)(zeng)速、與省級(ji)政府(fu)性(xing)(xing)融資(zi)(zi)擔(dan)保(bao)(bao)(bao)(bao)機構(gou)(gou)(gou)合作業(ye)(ye)務規模等因素,給予州(市)級(ji)政府(fu)性(xing)(xing)融資(zi)(zi)擔(dan)保(bao)(bao)(bao)(bao)機構(gou)(gou)(gou)以獎代(dai)補(bu)(bu)(bu)支(zhi)持(chi),并根據工(gong)作考核結果(guo)進行調整,激發州(市)級(ji)政府(fu)性(xing)(xing)融資(zi)(zi)擔(dan)保(bao)(bao)(bao)(bao)機構(gou)(gou)(gou)拓(tuo)展業(ye)(ye)務內(nei)生動(dong)力(li)。
(十五)科學建立代(dai)償(chang)補助(zhu)機制(zhi)。各州(zhou)(市)財(cai)政(zheng)部門要參照財(cai)政(zheng)部做法,根據(ju)政(zheng)府性融(rong)資(zi)擔(dan)保機構(gou)(gou)的(de)業務規模(mo)(mo)、平(ping)均分(fen)險(xian)比例、基準代(dai)償(chang)率(lv)、基準擔(dan)保費(fei)率(lv)、基準資(zi)金運(yun)作(zuo)收益率(lv)、基準成本費(fei)用率(lv)等因素合理(li)確定(ding)代(dai)償(chang)補助(zhu)資(zi)金,結合工作(zuo)考核結果進行(xing)調整。壓實政(zheng)府性融(rong)資(zi)擔(dan)保機構(gou)(gou)經營管(guan)理(li)責任,加強(qiang)(qiang)與(yu)債權銀行(xing)的(de)工作(zuo)協同,推動代(dai)償(chang)機制(zhi)有效運(yun)行(xing),實現風險(xian)補償(chang)后(hou)收支“緊平(ping)衡”,達到增強(qiang)(qiang)擔(dan)保能力、增強(qiang)(qiang)管(guan)理(li)水平(ping)、控制(zhi)業務規模(mo)(mo)、控制(zhi)擔(dan)保風險(xian)的(de)“兩增兩控”要求。
(十(shi)六)落實財稅(shui)(shui)扶持政(zheng)策(ce)。各州(市)人(ren)民政(zheng)府要建立與本級(ji)政(zheng)府性融(rong)資擔(dan)保(bao)(bao)(bao)機(ji)構業(ye)務(wu)發展相適應的資本金(jin)補充、擔(dan)保(bao)(bao)(bao)費補貼和代(dai)償補助機(ji)制,納入一般公共預算予以保(bao)(bao)(bao)障。政(zheng)府性融(rong)資擔(dan)保(bao)(bao)(bao)機(ji)構的代(dai)償損失核銷,參(can)照金(jin)融(rong)企(qi)業(ye)呆(dai)賬核銷管(guan)理辦法(fa)執行。對符合條件的融(rong)資擔(dan)保(bao)(bao)(bao)公司實施擔(dan)保(bao)(bao)(bao)賠(pei)償準備(bei)金(jin)、未到期責(ze)任(ren)準備(bei)金(jin)企(qi)業(ye)所(suo)得稅(shui)(shui)稅(shui)(shui)前(qian)扣除,以及免征增值稅(shui)(shui)、西部大開發企(qi)業(ye)所(suo)得稅(shui)(shui)稅(shui)(shui)率優惠等政(zheng)策(ce)。
六、優化監(jian)管考核機制(zhi)
(十七)嚴格落實監(jian)管(guan)(guan)(guan)責任。省(sheng)財政(zheng)(zheng)廳對省(sheng)級政(zheng)(zheng)府(fu)性(xing)融資(zi)擔(dan)保(bao)機構(gou)(gou)要加(jia)強指(zhi)導(dao),建立重大事項報備制度(du)(du)。各州(zhou)(市)人民政(zheng)(zheng)府(fu)作為監(jian)管(guan)(guan)(guan)責任主體,要統(tong)籌發(fa)展(zhan)(zhan)和安全,牢牢守住不發(fa)生系統(tong)性(xing)風(feng)(feng)險的底(di)線。地(di)方金(jin)融管(guan)(guan)(guan)理部門要完善(shan)支(zhi)小支(zhi)農擔(dan)保(bao)貸款監(jian)管(guan)(guan)(guan)政(zheng)(zheng)策,統(tong)籌運用(yong)(yong)現場(chang)監(jian)管(guan)(guan)(guan)、非現場(chang)監(jian)管(guan)(guan)(guan)等(deng)手段加(jia)大業(ye)務合規(gui)性(xing)檢(jian)查,督促指(zhi)導(dao)政(zheng)(zheng)府(fu)性(xing)融資(zi)擔(dan)保(bao)機構(gou)(gou)完善(shan)保(bao)前、保(bao)中、保(bao)后風(feng)(feng)險管(guan)(guan)(guan)理措(cuo)施,細化全流程全崗位(wei)盡(jin)職免責制度(du)(du)。審計(ji)部門要加(jia)大監(jian)督檢(jian)查力度(du)(du),把政(zheng)(zheng)府(fu)性(xing)融資(zi)擔(dan)保(bao)機構(gou)(gou)政(zheng)(zheng)策落實、業(ye)務開展(zhan)(zhan)、資(zi)產質量、風(feng)(feng)險防控以及財政(zheng)(zheng)資(zi)金(jin)使(shi)用(yong)(yong)效率等(deng)情(qing)況(kuang)列入審計(ji)重點內容,堅決懲(cheng)治金(jin)融腐敗(bai)。
(十八)加大風險預(yu)警防控。各州(市)人(ren)民政(zheng)府(fu)(fu)不(bu)得干預(yu)政(zheng)府(fu)(fu)性(xing)融(rong)(rong)(rong)(rong)資(zi)(zi)擔保機構(gou)(gou)(gou)日常經營(ying)(ying)決策,不(bu)得違(wei)規要求政(zheng)府(fu)(fu)性(xing)融(rong)(rong)(rong)(rong)資(zi)(zi)擔保機構(gou)(gou)(gou)偏(pian)離主業(ye)盲(mang)目擴大業(ye)務(wu)范圍或借用資(zi)(zi)本(ben)金用于融(rong)(rong)(rong)(rong)資(zi)(zi)平臺債務(wu)周(zhou)轉(zhuan)。政(zheng)府(fu)(fu)性(xing)融(rong)(rong)(rong)(rong)資(zi)(zi)擔保機構(gou)(gou)(gou)不(bu)得為政(zheng)府(fu)(fu)債券發(fa)行提(ti)供擔保,不(bu)得為融(rong)(rong)(rong)(rong)資(zi)(zi)平臺融(rong)(rong)(rong)(rong)資(zi)(zi)提(ti)供增(zeng)信,不(bu)得對非(fei)融(rong)(rong)(rong)(rong)資(zi)(zi)擔保機構(gou)(gou)(gou)進(jin)行股權(quan)投資(zi)(zi)。地(di)方金融(rong)(rong)(rong)(rong)管理部(bu)門要建立(li)健全政(zheng)府(fu)(fu)性(xing)融(rong)(rong)(rong)(rong)資(zi)(zi)擔保機構(gou)(gou)(gou)風險預(yu)警機制,堅(jian)決打(da)擊抽逃資(zi)(zi)本(ben)金行為,加強(qiang)風險分類管理,避免政(zheng)府(fu)(fu)性(xing)融(rong)(rong)(rong)(rong)資(zi)(zi)擔保機構(gou)(gou)(gou)因自(zi)身經營(ying)(ying)問題(ti)引發(fa)系統(tong)性(xing)金融(rong)(rong)(rong)(rong)風險。融(rong)(rong)(rong)(rong)資(zi)(zi)擔保行業(ye)協會要研究制定從業(ye)人(ren)員管理制度,提(ti)高人(ren)員素質(zhi),推進(jin)隊(dui)伍(wu)建設,不(bu)斷提(ti)升業(ye)務(wu)技能。
(十九)完(wan)善績(ji)效考核機(ji)(ji)制。云南金(jin)(jin)融(rong)監管局要(yao)將銀行(xing)與政府性融(rong)資(zi)擔(dan)(dan)(dan)保機(ji)(ji)構(gou)合作情況作為單獨指標(biao),納入商業(ye)銀行(xing)小微企(qi)業(ye)金(jin)(jin)融(rong)服務監管評(ping)(ping)價(jia)(jia)(jia)體(ti)系,提升(sheng)銀行(xing)開展擔(dan)(dan)(dan)保業(ye)務的積極(ji)性。銀行(xing)業(ye)金(jin)(jin)融(rong)機(ji)(ji)構(gou)要(yao)對支(zhi)小支(zhi)農(nong)業(ye)務實行(xing)內部資(zi)金(jin)(jin)轉移優(you)惠定價(jia)(jia)(jia),切實降低小微企(qi)業(ye)和(he)“三農(nong)”主體(ti)融(rong)資(zi)成本。各州(市)財政部門(men)要(yao)完(wan)善政府性融(rong)資(zi)擔(dan)(dan)(dan)保機(ji)(ji)構(gou)績(ji)效評(ping)(ping)價(jia)(jia)(jia)體(ti)系,定期組織開展績(ji)效評(ping)(ping)價(jia)(jia)(jia),突出支(zhi)小支(zhi)農(nong)規模(mo)、優(you)化擔(dan)(dan)(dan)保支(zhi)持行(xing)業(ye)結(jie)構(gou)等導向(xiang),降低利潤考核要(yao)求,加大風險防控比重,并將考核結(jie)果直(zhi)接運用于政府性融(rong)資(zi)擔(dan)(dan)(dan)保機(ji)(ji)構(gou)的經營業(ye)績(ji)考核、領(ling)導任期激(ji)勵和(he)工(gong)資(zi)總額核定。政府性融(rong)資(zi)擔(dan)(dan)(dan)保機(ji)(ji)構(gou)負(fu)責人薪酬(chou)及履職待遇參照地(di)方(fang)金(jin)(jin)融(rong)企(qi)業(ye)負(fu)責人薪酬(chou)及履職待遇規定執行(xing)。
(二十)優化公(gong)司治理(li)(li)(li)結構。政府性融資擔保機(ji)(ji)構要(yao)按照(zhao)政策(ce)引導、專業管(guan)(guan)理(li)(li)(li)、市(shi)場化運作的(de)原(yuan)則,加(jia)強自身能力建設(she),推(tui)動(dong)建立(li)(li)“能擔、愿(yuan)擔、敢擔”的(de)長效機(ji)(ji)制(zhi)。建立(li)(li)健全產權清晰(xi)、權責(ze)明確、政企(qi)分開(kai)、管(guan)(guan)理(li)(li)(li)科(ke)學的(de)現(xian)代企(qi)業管(guan)(guan)理(li)(li)(li)制(zhi)度,建立(li)(li)完善決策(ce)、管(guan)(guan)理(li)(li)(li)、監督相互制(zhi)衡,激(ji)勵、約束相互匹(pi)配的(de)內(nei)控機(ji)(ji)制(zhi),做實(shi)資本、做強機(ji)(ji)構、做精業務、嚴控風(feng)險(xian),實(shi)現(xian)專業化、精細化管(guan)(guan)理(li)(li)(li),不斷提升規范運作水平,打(da)造忠誠干(gan)凈擔當(dang)的(de)政府性融資擔保人才隊伍(wu)。
